1. About Aaspass

Aaspass is a marketplace platform that enables home chefs and local food sellers (“Sellers”) to list and sell food to nearby customers (“Buyers”) in India. By creating an account and using Aaspass, you agree to these terms.

2. Eligibility

You must be 18 years or older to use Aaspass. By using the platform, you represent that you meet this requirement and that all information you provide is accurate.

3. Buyer Terms

• Orders placed on Aaspass are contracts directly between you and the Seller. Aaspass is a facilitator, not a party to the transaction.
• Payment is made directly to the Seller via cash on delivery or UPI transfer at the time of delivery or pickup.
• Order cancellations are subject to the Seller's discretion. Once an order is accepted, cancellations may not be possible.
• If you receive incorrect or unsatisfactory food, contact the Seller directly via WhatsApp (link available in your order).
• Pre-orders are placed in advance for a specific date and time. Pre-order cancellation is only possible before the Seller accepts.

4. Seller Terms

• Sellers are responsible for the quality, safety, accuracy, and legality of all food listed and sold on Aaspass.
• Sellers must comply with all applicable food safety regulations in India, including FSSAI requirements. Aaspass does not verify FSSAI registration but may display it as provided.
• Sellers must keep their menu, prices, and availability accurate and up to date.
• Sellers agree to honour accepted orders. Frequent cancellations may result in account suspension.
• Aaspass does not charge a commission on orders. The platform is free to use for Sellers during the beta period.

5. Prohibited Conduct

You must not:

• Use Aaspass for any unlawful purpose or in violation of any Indian law.
• List or sell prohibited food items (alcohol, controlled substances, etc.).
• Create multiple accounts or impersonate others.
• Attempt to bypass the platform's security, payments, or order systems.
• Post false, misleading, or fraudulent information.

6. Platform Availability

Aaspass is provided on an “as-is” and “as-available” basis. We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the platform at any time with reasonable notice.

7. Limitation of Liability

Aaspass is a marketplace facilitator. We are not liable for the quality, safety, or legality of food sold by Sellers. To the maximum extent permitted by law, our liability for any claim arising from use of the platform is limited to ₹1,000.

8. Intellectual Property

The Aaspass name, logo, and platform design are our property. Sellers retain ownership of the content they upload (photos, descriptions) but grant Aaspass a non-exclusive licence to display it on the platform.

9. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
